Sensitive Locations for Concealed Carry in NYC

Navigating Sensitive Locations for Concealed Carry in NYC

In the wake of the landmark Supreme Court decision in New York State Rifle & Pistol Association vs. Bruen, New York’s concealed carry landscape has undergone significant changes. One of the most crucial aspects for concealed carry permit holders to understand is the concept of “sensitive locations.” This comprehensive guide will delve into what constitutes a sensitive location, the legal implications of carrying in these areas, and how to navigate the complex web of restrictions in New York.

What Are Sensitive Locations?

Sensitive locations are areas where the possession of firearms is prohibited, even for those with valid concealed carry permits. These restrictions were implemented as part of the Concealed Carry Improvement Act, enacted in response to the Supreme Court’s ruling.

Detailed Breakdown of Sensitive Locations

1. Government Buildings and Facilities

  • Courts
  • Police stations
  • City halls
  • State capitol buildings

“Any place owned or under the control of federal, state, or local government, for the purposes of government administration, including courts” is classified as a sensitive location. – New York Concealed Carry Improvement Act

2. Healthcare Facilities

Any location providing health, behavioral health, or chemical dependence care or services is off-limits for concealed carry. This encompasses:

  • Hospitals
  • Clinics
  • Mental health facilities
  • Substance abuse treatment centers

3. Places of Worship

All places of worship or religious observation are designated as sensitive locations. This includes:

  • Churches
  • Synagogues
  • Mosques
  • Temples

It’s important to note that recent court rulings have challenged this restriction. As of December 2023, firearms may be allowed in places of worship unless explicitly prohibited by the institution.

4. Educational Institutions

Schools and other educational facilities are strictly off-limits for concealed carry. This category includes:

  • K-12 schools
  • Colleges and universities
  • Daycare centers
  • Any place providing educational services

5. Public Transportation

Carrying firearms on public transportation is prohibited. This restriction covers:

  • Subways
  • Buses
  • Trains
  • Airports (beyond TSA checkpoints)

6. Entertainment Venues

Many entertainment and gathering places are designated as sensitive locations, including:

  • Theaters
  • Concert halls
  • Museums
  • Amusement parks

7. Parks and Recreational Areas

Public outdoor spaces are also included in the list of sensitive locations:

  • Public parks
  • Playgrounds
  • Zoos
  • Sports arenas

8. Times Square

The area commonly known as Times Square has been specifically designated as a sensitive location. This includes:

  • The area bound by Eighth Avenue, Fortieth Street, Sixth Avenue, and Fifty-third Street
  • The area bound by Ninth Avenue, Fortieth Street, Eighth Avenue, and Forty-Eighth Street

Exceptions to Sensitive Location Restrictions

While the list of sensitive locations is extensive, there are some exceptions to these restrictions. The following individuals may be exempt from these prohibitions:

  1. Law enforcement officers (active and retired)
  2. Security guards with special armed registration cards (while on duty)
  3. Active-duty military personnel
  4. Certain government employees with express written consent
  5. Individuals engaged in lawful hunting activities

“These restrictions do not apply to: Federal law enforcement officers carrying pursuant to the Law Enforcement Officers Safety Act; Police officers; Designated peace officers; Retired police officers…” – Giffords Law Center

Private Property Considerations

The Concealed Carry Improvement Act initially included a provision that made private properties “sensitive locations” by default, requiring owners to explicitly allow firearms on their premises. However, recent court rulings have challenged this aspect of the law.

As of the latest updates:

  1. Private businesses are no longer considered sensitive locations by default.
  2. Property owners retain the right to prohibit firearms on their premises.
  3. Clear and conspicuous signage is required if firearms are not permitted.

Best Practices for Concealed Carry Permit Holders

Given the complexity of sensitive location restrictions, concealed carry permit holders should adhere to the following best practices:

  1. Stay informed about current laws and regulations, as they may change due to ongoing legal challenges.
  2. Assume a location is off-limits unless you have confirmed otherwise.
  3. Look for clear signage indicating whether firearms are permitted or prohibited in private establishments.
  4. Be prepared to secure your firearm safely if you unexpectedly need to enter a sensitive location.
  5. Consider using a smartphone app or carrying a printed list of sensitive locations for quick reference.

The Impact on Concealed Carry in New York City

New York City presents additional challenges for concealed carry permit holders. A New York state license to carry a handgun is generally not valid in New York City without an additional permit issued by local law enforcement. This means that even if you have a valid concealed carry permit for New York State, you may not be authorized to carry within the five boroughs of NYC.

The landscape of concealed carry laws in New York, particularly regarding sensitive locations, remains in flux. Legal challenges continue to shape the interpretation and enforcement of these restrictions. As of early 2024, several aspects of the law are under review by the courts, including:

  1. The requirement to disclose social media accounts for permit applications
  2. The default prohibition of firearms on private property
  3. The blanket ban on firearms in places of worship

Concealed carry permit holders should stay vigilant and regularly check for updates to ensure compliance with the most current regulations.

Property Security Evaluation Report

Your Individualized Property Evaluation Report

Your site’s individualized property evaluation report contains information and analysis that you need to properly manage your site’s security needs. That information includes detailed analysis of the crime rate in your area, site access and parking protocols, and existing security infrastructure. Interior inspection includes analysis of emergency exits, fire suppression capabilities, and alarm infrastructure for emergencies. Exterior inspection includes analysis of structural defects, property lighting, and potential vulnerabilities in building access.

In addition to those inspections, our analysis also considered environmental factors, potential risks from older trees, outside property maintenance, and nearby crime that may overflow to the area. We also examined emergency response planning, including fire evacuation protocols and information supplied to residents about proper evacuation process.

Pressing Suggestions

We highly suggest a camera placement along this driveway, as the overhead cameras in the back parking lot may not capture all makes, models, and license plates of cars entering in and out based on the angle they are recording from. The best camera placement would be at the green circle closest to the sidewalk/street.
The common area is easily accessible, but based on the angle that cameras are set at the front lot, anyone can enter the basement common area concealing the side of their face that is facing the camera. This is not to say that the camera arrangement should be changed, but it is highly recommended to have coverage in this common area as the common area is on a lower floor not visible from the sidewalk.

However, a few fundamental problems exist when it comes to access control of the back parking (a big territory). Even though only two issues have ever occurred there, the wide-open access point to that lot may need to be corrected sooner than later as there is a significant uptick in crime in the 62nd precinct.

Furthermore, there are two fundamental surveillance blind spots along the driveway leading to the back parking lot and every common area.

Lastly, however unlikely it may seem, tenants should have resources and a physical guide for situations that may require an evacuation. Whether it be a flood or fire, each tenant should know how to use a fire extinguisher and where to evacuate to during a flood regardless of their proximity to a shoreline.
